1. General Terms
1.1 The Seller guarantees that the kitten/cat is purebred and eligible for registration in The International Cat Association (TICA).
1.2 Failure to Deliver Reserved Kitten — If the Seller is unable to deliver the specific reserved kitten due to circumstances beyond the Seller’s control (including, but not limited to, illness, injury, or death of the kitten), the Purchaser shall have the option of selecting another available kitten of equal value, or receiving a full refund of all monies paid, including the deposit. This guarantee does not apply in cases where delivery is prevented due to the Purchaser’s failure to complete pickup or transportation arrangements. In such cases, the Purchaser forfeits the deposit and any payments already made without prior arrangements made with the Seller.
1.3 The Kitten shall not be sold, leased, given away, or abandoned to a shelter, pound, pet shop, research laboratory, humane organization, or any similar facility. If the Purchaser is unable to care for the Kitten, the Purchaser shall notify the Seller immediately. The Purchaser shall use all reasonable effort to rehome the Kitten and shall provide details (in writing) of the Kitten’s new owner to the Seller. If for any reason at any time the Purchaser does not want this kitten, the Purchaser agrees to return the cat/kitten back to the Seller free of charge.
1.4 The Kitten shall be kept strictly indoors. The Purchaser shall not allow the Kitten to roam outside unless leashed and accompanied by a responsible adult.
1.5 The Purchaser agrees that the Kitten shall never be declawed. Declawing is considered dismemberment and animal abuse, and it will void all health guarantees under this Agreement. Purchaser agrees to use alternative humane methods (scratching posts, nail trims, claw caps, etc.) to manage scratching behavior.
1.6 Purchaser acknowledges that no guarantees are made regarding the kitten’s temperament. While the Seller socializes kittens, behavior after leaving the cattery cannot be predicted. It is the Purchaser’s responsibility to transition the kitten gradually into its new home. Seller does not guarantee personality, size, coat color or consistency, or disposition of the Kitten at maturity.
1.7 Delivery of Kitten
The Purchaser has the following options for delivery of the Kitten:
- 1.7a Cattery Pick-up — Purchaser may elect to pick up the Kitten at the cattery with no additional costs or fees.
- 1.7b Air Cargo Shipment (Unattended) — Purchaser may elect to have the Kitten shipped to the closest major airport via air cargo, unattended. Purchaser is responsible for all shipping costs, including but not limited to airfare, an airline-approved travel carrier, and any required veterinary health certificates. This option is subject to the terms and conditions of the airline. The Seller is not liable for airline delays, cancellations, restrictions, or any health or safety risks associated with air travel. Airlines impose restrictions during extreme weather conditions (high heat or cold), typically during the summer and winter months, and unattended air shipment may not be available at those times.
- 1.7c Accompanied Flight (Attended) — Purchaser may elect to have the Kitten hand-delivered by the Seller to the Purchaser’s closest major airport. Purchaser shall be responsible for the cost of a round-trip airline ticket for the Seller, as well as all travel-related expenses (including but not limited to lodging, meals, and ground transportation, if applicable).
- 1.7d Ground Delivery by Car — For Purchasers located within 150 miles of the Seller’s location, the Seller may deliver the Kitten by car. Purchaser shall be responsible for a delivery fee of $0.50 per mile (round trip), calculated from the Seller’s location to the Purchaser’s address and back. This option is subject to the Seller’s availability and scheduling.
In all cases, once the Kitten is released into the custody of the Purchaser (or Purchaser’s authorized representative, airline, or transport provider), the Seller bears no further responsibility for the Kitten’s safety, health, or well-being during transport.
2. Care and Transition Requirements
2.1 Seller warrants that the Kitten was fully litter box trained at the time of transfer. However, the stress of a new environment may result in temporary improper elimination. Purchaser agrees to provide the same type of litter used at the Seller’s premises until the Kitten adjusts.
2.2 Purchaser agrees to continue feeding the Kitten the same diet provided at Seller’s premises and to introduce any changes gradually. Sudden changes in diet may result in diarrhea or digestive upset.
2.3 Purchaser agrees to provide the Kitten with a safe, loving, and healthy environment, including routine veterinary care, appropriate nutrition, and enrichment.
2.4 Purchaser must quarantine the Kitten for at least 14 days before introducing it to other pets. Failure to do so voids all health guarantees.
2.5 Seller is not responsible for illnesses in existing pets after the Kitten’s introduction, nor for illnesses in the Kitten caused by existing pets.
3. Health Guarantee
3.1 Seller warrants that Kitten is sold in good health at the time it leaves Seller’s premises, having been examined by a licensed veterinarian. Minor symptoms such as sneezing or mild discharge may occur due to stress or recent vaccinations.
3.2 Purchaser shall have the Kitten examined by a licensed veterinarian within 72 hours of arrival and shall provide proof of examination upon request. Any untreatable or life-threatening condition discovered must be reported to Seller immediately, in writing.
3.3 If the Kitten is found to have an untreatable or life-threatening condition within this timeframe, Purchaser may return the Kitten for a replacement of equal value or a refund of the purchase price (Seller’s choice). All veterinary and transport costs are the responsibility of Purchaser.
3.4 If within the first 12 months of the purchase date, the Kitten dies while in possession of the Purchaser due to a congenital or genetic defect, the Kitten will be covered by the Health Guarantee. Seller shall replace the Kitten with another kitten of equal value or refund the purchase price (Seller’s choice) if:
- 3.4a Purchaser must have a necropsy performed on the deceased Kitten by a licensed veterinarian or veterinary pathologist, and
- 3.4b The necropsy must show that the death was a direct result of the congenital or genetic defect.
The Seller reserves the right to obtain second opinions, tests, or necropsy to confirm the results prior to replacing the Kitten or refunding the purchase price.
3.5 Seller assumes no liability for veterinary costs incurred after transfer of possession.
3.6 Exclusions:
- 3.6a No guarantees against FIP (Feline Infectious Peritonitis). Purchaser agrees never to vaccinate the Kitten against FIP, as the vaccine is ineffective and potentially harmful.
- 3.6b No guarantees against parasites such as coccidia or giardia, which can occur under stress.
- 3.6c No guarantees for diseases contracted due to lack of diligence of vaccinations once the Kitten has left the Buyer’s care.
4. Pet, Show, and Breeding Rights
4.1 If the Kitten is sold as “Pet/Show Rights” as indicated in Section 3 of this agreement, the Purchaser agrees that this Kitten is sold strictly as a pet only and under no circumstances shall the Kitten be used for breeding.
- 4.1a Any attempt to breed the Kitten will be considered a material breach of this contract and will result in a $5,000 penalty per litter for the Purchaser.
- 4.1b The Purchaser must spay or neuter the Kitten prior to 1 year of the Kitten’s date of birth.
- 4.1c The Purchaser may register the Kitten in any cat show if it qualifies. The Seller is not responsible for any denials of entry, performance, or disqualifications.
4.2 If the Kitten is sold as “Breeding/Show Rights” as indicated in Section 3 of this agreement, the Purchaser agrees to adhere to the breeding addendum of the agreement.
5. Breach of Contract and Dispute Resolution
5.1 If this contract is breached in any way (including but not limited to breeding, declawing, or resale in violation of terms), Purchaser will surrender the cat/kitten back to the Seller without refund and at Purchaser’s expense, with a signed Transfer of Ownership.
5.2 Purchaser agrees that if legal action is necessary, all legal fees will be the Purchaser’s responsibility for both parties, and all actions will be filed in the Seller’s current state and county of residence.
5.3 Both parties agree that disputes shall be handled privately and shall not be publicized on social media, forums, or online platforms. Public disclosure of disputes shall result in liquidated damages of $1,000 payable to the non-breaching party.
6. Governing Law
6.1 This Agreement shall be final and binding upon the Purchaser and Seller and shall be governed by the laws of the State of Texas. There are no other conditions or guarantees, verbal or implied. No verbal deviation or additions are valid. No other warranties or guarantees are provided other than those specifically outlined in the agreement. All prior agreements, representations, and warranties expressed or implied, orally or written, with respect to the subject matter hereof, are hereby superseded by this contract.
